Transferred Far From Home
Your employer moved you far away with little notice and resigning feels forced.
A letter arrived moving you to a branch hours from home, with little notice and no real talk about your circumstances.
Employers can move staff, but that right has limits. A transfer meant to punish you or push you out can become a transfer dispute.
When does a transfer become pressure to resign?
A transfer becomes a problem when it breaches your contract or comes right after a complaint you made. The same contract test used in constructive dismissal claims applies.1
Courts ask whether the transfer served a real business need or targeted you. A sudden move right after a grievance is treated very differently from a company-wide relocation.
Does a mobility clause change anything?
If your contract lets your employer transfer staff, it has more room to move you. It must still use that power reasonably.
If there is no such clause, or the move contradicts what you were told when hired, your position is stronger. Read your offer letter for any wording about location.
What should you keep now?
Keep the transfer letter, your offer letter showing your work location, and any message giving the business reason.
Note the distance and travel time involved. Note any family or medical circumstances you told your employer about.
How long do you have once you leave?
If you resign because of the transfer, you have 60 days from then to file a Section 20 representation with the Director General of Industrial Relations.2
Your employer then has to justify the transfer as reasonable. You do not have to disprove it.3
What should you do this week?
Write a short, polite letter asking your employer to explain the business reason and to consider your circumstances. Keep a copy and any reply.
If the transfer came with a change in duties, read about duties being quietly removed. Use the deadline calculator to check your dates before you decide.
If you want a lawyer to read the letter against your contract, request lawyer contact first; only after an identified independent lawyer has contacted you and specifically requested the material, send both directly to that lawyer.
If you are considering challenging a transfer far from home, an independent employment lawyer can read the transfer letter against your contract and tell you whether it is worth pursuing.

Common questions
Can my employer transfer me anywhere?
Only within the limits of your contract and fairness. A transfer clause gives wide power but not unlimited power, and a move meant to punish you or force you out can be challenged as a breach.
What if my contract has no transfer clause?
Then your employer has less room to insist on a move, especially somewhere far from your workplace. That gap can support your case if you cannot accept the transfer.
Should I try the new site before I resign?
Some workers do, to show they gave it a fair chance, and others resign once the impact is clear. Either can work, but record your reasons and any hardship as you go.
Does distance alone make a transfer unfair?
No. Distance is one factor, alongside the notice given, the reason offered and whether other staff were treated the same. Very short notice for a long move weighs heavily in your favour.
