Your employer closed. What are you owed?
Everyone lost their jobs at once, and the payments are unclear.
The doors closed, the announcement came, and everyone, you included, lost their job at the same time. You still have real questions about what you are owed.
A genuine company closure differs from a selective retrenchment, but it does not erase every right you have.
Does a full closure mean nobody was treated unfairly?
Not entirely. A genuine closure affecting everyone equally removes some fairness questions that arise in a selective retrenchment, since nobody was singled out.
Even so, you can still claim proper notice or pay in lieu, and any termination entitlements your contract or length of service provides.
What if the closure seemed sudden or unexplained?
Ask for the company’s own account of why it closed and whether staff got advance notice before the announcement.
A closure with no notice at all, or one that seems timed to avoid other obligations, deserves a closer look.
What support is available beyond an unfair dismissal claim?
Workers who lose a job through a genuine closure can apply to the Social Security Organisation (PERKESO) for Employment Insurance System support. This includes a job search allowance for three to six months, if you apply within 60 days.3
This support is separate from any claim about how the closure was handled or the payments you received.
Who has to justify the closure if you challenge it?
If you believe the closure was not genuine, or was used to avoid paying you, your employer must show it was handled fairly.1
You have 60 days from the closure or your last day to file a Section 20 representation if you want to challenge it.2 This is the written claim you lodge to say your dismissal was unfair, and it goes to the Director General of Industrial Relations.
What should you do this week?
Gather your final payslip, contract, and any closure announcement or letter explaining what payments you will receive. Apply for Employment Insurance System support through PERKESO if you have not already.
If a sale or takeover was involved, read about a change of ownership leading to termination. Then use the deadline calculator to check your window.
If you want a lawyer to recover what you are owed, request lawyer contact first; only after an identified independent lawyer has contacted you and specifically requested the material, send the closure letter and your final payslip directly to that lawyer. They can review whether it is a case they can act on.

Common questions
Am I automatically entitled to compensation when a company closes?
It depends on your contract terms and length of service, because a genuine closure with proper notice differs from a wrongful termination. Review your contract and any closure letter closely.
Can I apply for the Employment Insurance System even during a full closure?
Yes. Workers who lose their job involuntarily through a genuine closure can apply, within the usual 60-day window, to the Social Security Organisation (PERKESO). This support runs alongside, not instead of, any unfair dismissal claim.
What if some staff were kept on despite the announced closure?
If the closure was not actually complete, or some staff were kept on under a different arrangement, that can affect whether the closure was genuine. Note who stayed and why.
Does a company closure protect the employer from every claim?
No. A genuine closure limits some arguments about unfair selection, but it does not remove your right to proper payments or to challenge how the closure was handled.
