Salary cut

When does a salary cut become dismissal?

Your employer cut your pay without your agreement and you are thinking of leaving.

Can a salary cut count as constructive dismissal?

Sometimes, if the cut is serious enough and you respond within a reasonable time. Pay is a core term of the contract, so a large one-sided cut can meet the contract test.

That test asks whether the employer’s conduct breaches the contract at its root, or shows an intention no longer to be bound by it.1 A cut made without consultation, explanation or agreement is far more likely to meet it than one you discussed and accepted.

What strengthens this kind of claim?

A large cut applied suddenly with no business reason points to a serious breach, not a minor adjustment. A written objection sent at the time, even a short one, shows you did not simply accept the new terms.

Bayer (M) Sdn Bhd v Anwar Abd Rahim also requires the breach to be serious and the resignation to follow reasonably promptly.2 Waiting many months after the cut can weaken a strong case.

How does the employer’s explanation matter?

A cut explained as temporary and tied to a verifiable business reason is treated differently from one with no explanation. If you were told it was temporary but it has run past any stated end date, note that clearly and raise it in writing.

What should you do if your pay was cut?

Write down the old figure, the new figure, the date it changed and any reason given.

Compare your payslips before and after the change, and send a short written objection if you have not yet. Keep a copy.

Read about demotions and loss of duties too, because pay cuts often come with other changes. If you want a lawyer to judge whether your cut meets the test, an employment lawyer can review it and act if it does.

A pay cut pushed you to leave, or is pushing you now. An independent employment lawyer can review the change against your contract and act on a claim if you have one.

Common questions

Does any pay cut count as constructive dismissal?

No. A small cut with a clear business reason is treated differently from a sudden, unexplained or punitive one. Size, explanation and whether you agreed all affect how the cut is viewed.

What if I accepted the cut at the time?

Accepting it, even reluctantly, and working on the new terms for a long time can be read as agreeing to the change. If you object, put it in writing as soon as you can.

Does a bonus cut count the same as a base salary cut?

Discretionary bonuses are usually treated differently from fixed base pay, because they depend on company or personal performance. A cut to a contractually fixed part of your pay is easier to challenge.

Should I resign immediately after a pay cut is announced?

Not necessarily straight away, but do not wait for months. Send a written objection first, then decide within a reasonable time, because delay can count against the timing condition.
