Offered a quiet exit? Read this first
You were offered a quiet exit from a senior role and are unsure if the terms are fair.
What should you check before agreeing to a quiet exit?
Read the agreement slowly, and do not let the offer’s deadline rush you. A deadline of a few days limits how much you can compare it with your other options.
Look closely at the release clause. It usually asks you to give up any future claim about your employment once you accept. This is the heart of an executive exit deal.
What should the package be measured against?
Put the offer beside your notice entitlement, and any bonus or unvested equity you would otherwise be due. Then compare it with what a Section 20 claim could bring, if the exit is really a dismissal in softer form.
Back wages in a successful claim are capped at twenty four months for a confirmed employee.1 That is a ceiling, not a promise for any case, so use it as context and not as a target.
Legal fees, time and the uncertainty of a hearing belong in the comparison too, not only the headline figure.
Does being senior change your legal position?
No. Seniority does not remove your right to challenge a dismissal without just cause or excuse, even when the exit is dressed up as mutual.
What changes at senior level is the complexity of the package, not the unfair dismissal principles behind it. Notice periods, equity schedules and confidentiality terms have more layers the higher the contract sits.
What should you do before you reply?
Ask for the offer in writing, and ask for time to review it instead of answering on the spot. If you decide not to accept and are later dismissed, you have 60 days from that date to file a claim.2
Keep track of that window with the deadline calculator.
If you want someone to negotiate for you, a lawyer can read the release clause and the figures before you sign anything.
If you have been offered an exit package, an independent employment lawyer can review the terms and negotiate for you before you sign.

Common questions
Should I sign a quiet exit offer straight away?
No. Ask for time to read the agreement properly before you reply. Signing quickly can close off options you have not fully considered.
What should I compare the offer against?
Compare it with your notice entitlement and any bonus or equity due to you. Then compare it with what a Section 20 claim could involve, if the exit is really a dismissal in disguise.
Does a senior title change my legal position?
No. Seniority does not remove your right to challenge a dismissal that lacks just cause or excuse. It can change how a case is argued, but not whether you can bring one.
What does a release clause in the agreement actually do?
It usually asks you to give up any future claims about your employment in return for the package. Have a lawyer read that clause before you sign.
