Were you given enough notice?

Your employer owes you notice or pay in place of it, and you can check which.

A notice period is an everyday detail that is easy to overlook in the middle of a bigger dispute. It is also one of the easiest things to check.

What it means

It is the warning time either side should give before ending employment. Your contract sets it, and the Employment Act gives baseline protection for many employees.

Where notice is not given, the usual substitute is a payment for that same period. It is called notice pay, or pay in lieu of notice.

Why it matters to you

Skipping notice without paying you in lieu is easy to check from your contract and payslips. The exception is a genuine summary dismissal for serious misconduct.

This is separate from the bigger question of whether the dismissal was fair, though both can come from the same event.

What if you were not given notice

Compare the notice period in your contract with what you actually received, whether as working notice or as a payment. Note any gap in writing.

If the gap is a plain underpayment and not a fairness dispute, it may sit closer to the Labour Department than to an unfair dismissal claim.

Either way, check your 60-day window for the dismissal itself on the deadline calculator. That clock does not wait for a notice pay dispute.

If the notice you were given was short or missing, send the date and what happened. An independent employment lawyer can review whether it is a case they can take on.

Common questions

Can my employer just tell me to leave immediately?

An employer can end employment immediately, but this usually means paying you in place of the notice you were owed. The exception is a dismissal for serious misconduct that justifies skipping notice entirely.

What sets the length of my notice period?

It is usually set by your contract, with the Employment Act giving minimum protection for many employees. Your written contract is the fastest way to confirm your figure.
