Probation

Probation extended or terminated?

Your probation was extended or ended and you are unsure what that means for you.

How is a probation extension different from a termination?

An extension keeps you employed with more time to prove yourself, while a termination ends the job. Both feel like a verdict on your work, but they raise different questions.

If you are later dismissed, the employer must still prove just cause or excuse, however many extensions came before.1 A pattern of extensions with vague or shifting reasons can become part of that picture.

What can repeated extensions suggest?

One extension with a clear reason and a set end date is common. Repeated extensions with no explanation, or goals that keep changing, are worth writing down as they happen.

The Employment Act amendments in force since 1 January 2023 cover all employees regardless of wage, so its basic protections apply to you whatever your pay.2 Keep a note each time your probation is extended, with the stated reason.

How should you respond?

If you are offered an extension, ask in writing for the specific reason and the new end date. Ask what exactly must improve before the next review, because a vague instruction to do better is hard to act on and hard to challenge later.

Written targets, even informal ones sent by email, give you something to work toward and point back to. If your employer refuses to put anything in writing, remember that too.

If you are terminated instead, confirm the date and save your documents. Read what to do right after being fired during probation for the checklist.

Who can read the whole pattern?

If you want a lawyer to act, an employment lawyer can read the extensions and the final outcome together and tell you whether there is a claim.

Your probation was extended or ended, and you are considering a challenge. An independent employment lawyer can review your offer letter and act on it if there is a claim.

Common questions

Can my employer extend my probation indefinitely?

Repeated extensions with no clear end point or reason are worth questioning, because they can suggest the role was never going to be confirmed. Ask for the reason in writing each time.

Is an extension better or worse than a termination?

Neither is better by default. An extension keeps you employed while the uncertainty continues; a termination ends the uncertainty but also the income.

Do I have to accept an extension?

You can raise concerns, especially if there is no clear reason or timeline, but refusing outright carries its own risk. Getting the terms of any extension in writing is the safer first step.

What if I am terminated right after an extension?

Document that sequence closely, especially the reasons given for both. Any inconsistency between them can matter if you later raise an unfair dismissal claim.
